OSHA Settles Whistleblower Case with Tennessee Company

The federal government's workplace safety agency recently settled a case with a trucking company in Tennessee after it fired a whistleblower.

Knoxville-based Heartland Transportation came to an agreement with the U.S. Department of Labor’s Occupational Safety and Health Administration to reinstated a worker who it fired after he filed a complaint about unsafe vehicles. The termination that followed was found to have violated the Surface Transportation Assistance Act.

The local OSHA leadership said workers should be able to report safety hazards without fearing retaliation.

"OSHA will continue to ensure that the whistleblower protection provisions of the STAA are properly and thoroughly enforced, while always keeping open the opportunity for settlement negotiations," said Cindy A. Coe, OSHA's regional administrator in Atlanta. "In this case, we are pleased to enter into a settlement agreement that solidifies this commitment."

OSHA has been on the winning side of other recent whistleblower cases. In June, Judge Steven D. Merryday sided with the agency in a case against Florida-based Renaissance Arts and Education Inc.
