OSHA Fines DKS Structura Services 2012-07-12 |
The U.S. Department of Labor’s Occupational Safety and Health Administration fined Alabama-based DKS Structura Services, doing business as Don Kennedy and Sons House Moving Company, $122,400 after an employee complained about unsafe working conditions.
The whistleblower filed an official complaint under the federal government’s safety agency’s Section 11 (c) of the Occupational Safety and Health Act. That action resulted in an inspection. Investigators found that the firm had failed to provide proper cave-in and fall protections, failed to give workers the proper head protection and other issues that could have resulted in death or injury.
"This employer knowingly put workers at risk of serious injury or death by ordering them back to work in an unprotected trench after experiencing a cave-in," said Lisa Strunk, OSHA's acting area director in Birmingham. "Risking the safety of workers is not an acceptable business decision."
In recent months, many firms have received fines for cave-in hazards at worksites. Rhode Island-based Raymond J. Cawley Contracting was fined $117,000 after violating several safety standards.
